MOTION FOR RELEASE OF KNIFE
FOR SCIENTIFIC TESTING

Comes Petitioner, through counsel, and for his Motion for Release of Knife for Scientific Testing states:

1. At trial, a knife known as the "Byers Knife" was introduced into evidence as Defendants' Exhibit No. E6.

3. In connection with his Rule 37 petition, Petitioner desires to have further DNA testing made on the knife, based on reported advances in DNA technology since the time of Petitioner's trial.

4. The knife is in the custody of the court reporter for this Court.

5. In order to maintain the chain of custody, Petitioner requests this Court order the custodian of the knife to send it directly to Forensic Sciences, 3053 Research Dr., Richmond CA 94806  Attention: Ed Blake (510-222-8883).

WHEREFORE, Petitioner prays this Court order its court reporter to forthwith transmit said knife Forensic Sciences, 3053 Research Dr., Richmond CA 94806. Attention: Ed Blake.
